A. Generally.
Lexius is sensitive to protecting the private information
that our Customers provide to us. The loyalty of our
Customers is very important to us and we hope this policy
will underscore our commitment to ensuring that your
experience with us is a good one. This Privacy Policy
describes how Lexius treats information received about
you when you become a Customer or when you otherwise
provide information to us, for instance, by using our
Services.
B. Your Customer Information.
As part of the registration process for the Services,
you are asked to provide your name, address, email address,
telephone number(s) and (if applicable) credit card
or other billing information. This information is referred
to in this Privacy Policy as "Customer Information."
We retain all Customer Information on limited access
computers and, internally, this information is only
available to those employees who have a need to know.
Lexius will not disclose any of your Customer Information
except in accordance with this Privacy Policy.
C. How We Use Customer Information.
Lexius may send Customers periodic emails containing
information about Lexius, administrative notices about
your account (such as notices about pending activities),
updates on new Service features, Service usage tips,
information about third party products and services
that are likely to be of interest to Lexius Customers,
and Customer satisfaction questions. Lexius may also
access your Customer Information for the following administrative
purposes: (a) to examine system accounting logs, user
mailboxes and other company records to resolve email
and other system errors or problems; (b) for billing
purposes; (c) to ensure that only Lexius customers are
able to access certain member-only services; and (d)
to enforce the Lexius Terms Of Use policies outlined
in the Lexius Customer Agreement.
D. How We Allow Third Parties Access to Your
Customer Information.
Lexius will not permit third parties to have access
to your Customer Information except in the following
five instances:
(1) Lexius will provide access to certain of your Customer
Information to third party suppliers in order for them
to perform certain functions for us -- for example,
credit card numbers are sent to a credit card processing
company for billing and address information is given
to a fulfillment company that sends out our welcome
kits. These suppliers are not authorized to release
this information to other third parties.
(2) Lexius shares Customer Information in aggregated
form (e.g., demographic and profile information on groups
of Lexius Customers) with advertisers and others.
(3) Lexius will disclose your Customer Information in
cases where, in its discretion, it deems such disclosure
required or appropriate in order to comply with applicable
laws and regulations. For example, Lexius may disclose
such information to law enforcement, other government
officials, or third parties in response to criminal
or civil subpoenas.
(4) Not withstanding anything else contained in this
Privacy Policy, Lexius reserves the right to sell or
otherwise transfer your Customer Information to one
or more third parties in connection with a sale of Lexius
or its assets. You hereby authorize Lexius to disclose
or transfer your Customer Information in the circumstances
outlined above.
E. Access to the Contents of Your Communications.
Lexius acts as a passive conduit for you to send and
receive information of your own choosing. Therefore,
as a general rule, Lexius will not review or monitor
the contents of email or other communications sent or
received using the Services. This general rule is subject
to the following two exceptions:
(1) Certain technical processing of, and access to mail
messages and their content, may be required to route
messages, conform to connecting networks' technical
requirements, prevent or minimize disruptions to the
Services, or conform to other similar requirements.
(2) Lexius will disclose the contents of private communications
in cases where, in its discretion, it deems such disclosure
required or appropriate in order to comply with applicable
laws and regulations. For example, Lexius may disclose
such information to law enforcement, other government
officials, or third parties in response to criminal
or civil subpoenas. You hereby authorize Lexius to disclose
the contents of your private communications in the circumstances
outlined above. In addition to these limited exceptions,
third parties may illegally intercept or access transmissions,
private communications. For this and the other reasons
set forth above, Lexius does not promise, and you should
not expect, that private communications will always
remain private.
F. Cookies.
Like most websites, Lexius makes use of browser "cookies."
Cookies are files written to a user's hard disk and
read by server programs to inform a website if the user
has previously visited that site. Lexius uses cookies
to continually enhance your experience, and may use
them in the future to store customer preferences and
choices. We may also use one or more outside ad serving
companies to display advertisements on the Lexius Website.
These advertisements may contain cookies, which will
be used by the ad serving company for targeting purposes
only. Lexius will not have access to this information.
In addition, our account management web pages use cookies
to store and retrieve session identifiers that correspond
to a secure database containing each Customer's user
name. This is designed to facilitate Customer access
to Lexius’ Services. These account management
cookies do not enable third parties to access any of
your Customer Information
